Legal Battle between State General Prosecutor and IAAC Print E-mail

A legal “battle” between the State General Prosecutor and Independent Authority Against Corruption (IAAC) has been a centerpiece of Mongolian media last week.

The State General Prosecutor D.Dorligjav has requested, a third time in a row, the Speaker of Parliament D.Demberel to dismissal of chief commissars of the anti-corruption agency in a bid to continue criminal investigation whether he breached law while investigating higher ranking public officials.

Earlier, IAAC Head Ch.Sangaragchaa was reportedly blamed for a wiretapping scandal that involves several parliamentarians and his lower ranking officers. Last week, the agency’s investigative department head E.Amarbat was demoted after he was reportedly investigated for more than two weeks as some of the media reported.

Dorligjav requested, in his letter classified as “top secret”, the top legislative body to cooperate in the fight against corruption because the Parliament has repeatedly refused to discuss the “serious” issue and closed the session without touching it within legal period of 14 days. Now the issue is likely to be postponed until the Parliament’s autumn session resumes, to take time “to destroy” evidences and proof documents as some of the local media speculated, or an irregular session be called.

The prosecutor described his act as it is highly necessary to suspend impunity of those officers, who are “purposefully” making obstacles in his investigation.
But the parliament is seeing the request “politically” motivated. Dorligjav, a former chairman of the office of the President Ts.Elbegdorj, who is familiar for his campaign “beheading” corruption monsters, assumed the office of State General Prosecutor last May.
